All merchandise offered for sale by Swap Boutique, operated by Kora Style LLC is secondhand, pre-owned, vintage, or consigned. Items may show normal signs of prior use, including but not limited to minor scuffs, patina, fading, odor, or wear consistent with age and use. Swap Boutique makes reasonable efforts to inspect, describe, and where applicable authenticate items prior to listing, but does not warrant that every item is new, unused, or free of defects not disclosed in the listing.
No Affiliation, Sponsorship, or Endorsement
Swap Boutique is an independent secondhand/consignment retailer. Swap Boutique is not affiliated with, endorsed by, sponsored by, or an authorized dealer, distributor, or retailer for any brand, designer, or manufacturer named, pictured, or referenced on this website. Any use of a brand name, designer name, logo, or trademark on this site is used solely to identify, describe, and accurately list genuine secondhand goods that were originally manufactured and sold by that brand — not to suggest any business relationship, authorization, licensing, or partnership.
Why We Use Brand Names
We use brand names only to accurately describe the genuine items we sell. Under long-standing U.S. law, including the doctrines of nominative fair use and first sale, a reseller may truthfully identify a genuine, lawfully acquired item by its brand name and resell it without the brand owner’s permission. We use only as much of a brand name as needed to identify the item, and we do not intend to suggest any sponsorship, affiliation, or endorsement.
Swap Boutique only lists genuine, authentic items acquired through lawful consignment, purchase, or trade, and does not knowingly offer counterfeit goods. Any brand marks, images of packaging, care cards, or authentication marks appearing in listing photos depict the actual physical item for sale and are not used to imply sponsorship.
Response to Infringement Claims
We respect intellectual property rights and welcome concerns from rights holders. If you believe a specific listing infringes your rights, please email [marketing @ swapboutique.com] (remove the spaces) with:
- The specific trademark or copyrighted work at issue;
- A link to the listing;
- A brief explanation of your concern;
- Your contact information, and
- A good-faith statement that the use is not authorized.
We review notices promptly and in good faith. We may temporarily remove or edit a listing while we review it, request more information, and restore a listing if we determine the concern does not apply. Because we sell genuine pre-owned goods, a notice objecting only to a truthful brand reference on a genuine item may not result in removal.
False or Bad-Faith Claims
Please ensure any notice you submit is accurate and made in good faith. We may not act on incomplete notices, and we reserve all rights and remedies available under applicable law.
Trademark Ownership
All brand names, logos, and trademarks referenced on this site remain the property of their respective owners. Nothing on this site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark displayed on this site without the written permission of the trademark owner, except as necessary to describe genuine goods lawfully offered for resale.
Governing Law
This disclaimer is governed by the laws of Florida, without regard to conflict-of-law principles. Nothing in this disclaimer limits any statutory rights a consumer may have that cannot be waived under applicable law.
